TERMS AND CONDITIONS OF SALES AND SERVICES
All
orders placed via our web site www.auburnmetrologylab.com
or via telephone are subject to the Terms of this Agreement, including
the
following conditions of Order:
Any
change, alteration, deletion or modification of this Agreement is not
permitted, except with the written permission by an authorized Auburn
Metrology
Lab Inc. representative.
- In no event shall Auburn
Metrology Lab Inc. be liable to the buyer or to any third party for any
indirect, incidental, special, consequential, punitive or exemplary
damages (including without limitation lost profits, lost savings, or
loss of business opportunity) arising out of or relating to any product
or service provided or to be provided by Auburn Metrology Lab Inc. any
claim attributable to errors, omissions, or other inaccuracies in the
service and /or the content, unauthorized access to or alteration of
your transmissions or data, statements or conduct of any third party on
the site or the service, or any other matter relation to the products,
service, the site or any other matter relating to the products, the
site, the service or the content; even if Auburn Metrology Lab
Inc. has been advised of the possibility of such damages.
- Auburn Metrology
Lab’s Inc. sole obligation and liability for product defects
shall be, at Auburn Metrology Lab’s Inc. option, to repair such
defective product.
- The foregoing remedy
shall be subject to buyer’s written notification of defect and
return of the defective product within ninety (90) days of purchase.
- The foregoing remedy does
not apply to products that have been subject to misuse (including
without limitation static discharge), neglect, accident or
modification, or to products that have been soldered or altered during
assembly, or are otherwise not capable of being tested.
- ORDER VALIDATION AND
ACCEPTANCE
- When you place an order
with Auburn Metrology Lab Inc, we may verify your method of payment,
shipping address and /or tax- exempt identification number, if any,
before processing your order. Your placement of an order is
an offer to purchase our Products. Auburn Metrology Lab Inc. may
accept your order by processing your payment and shipping the Product,
or may, for any reason, decline to accept your order or any part of
your order. No order shall be considered to be accepted by Auburn
Metrology lab Inc. until the Product has been shipped. If we
decline to accept your order, we will attempt to notify you using the
e-mail address, fax or other contact information you have provided with
your order.
- Auburn Metrology Lab Inc.
may limit or cancel quantities available for purchase on any order on
any basis, and to alter the availability or duration of any special
offers at any time. Auburn Metrology Lab Inc. may reject any
order, or any part of any order.
- When you place an order
with Auburn Metrology Lab Inc. you are required to provide a valid
billing and shipping address, e-mail address, fax number and telephone.
This may be used to communicate with you regarding the status of your
order, advise you regarding shipment of backordered products, and
provide you with any other notices, disclosures or other communication
relating to your order. You agree that Auburn Metrology Lab Inc.
will not be responsible for any damage you incur, or information you do
not receive, as a result of your failure to provide a valid information
about your billing and shipping address, e-mail address, fax, telephone
numbers.
- PRICING AND PRODUCT
INFORMATION
- Auburn Metrology Lab Inc.
makes every effort to provide current and accurate information relating
to products and prices. However Auburn Metrology Lab Inc. does
not guarantee the currency or accuracy of any such information.
Information relating to products is subject to change without
notice. Prices are subject to change at any time prior to Auburn
Metrology Lab’s Inc. acceptance of your order. In the event
we, Auburn Metrology Lab Inc., discover a material error in the
description or availability of a Product that affects your outstanding
order with us or an error in pricing, we will notify you of the
corrected version. You may than choose to accept the corrected
version, or cancel the order.
- Auburn Metrology Lab,
Inc. offers the following payment methods:
- We accept
VISA, MASTERCARD, AMERICAN EXPRESS AND DISCOVER CARD. All
payments must be made in U.S. currency. Any other form of payment
will be accepted only with the prior approval of our finance department.
- We do not accept COD
orders. Personal or company checks will delay return shipment for
the check-clearing time (10-days).
- If a payment is not received within 30-days
of the date of the final invoice, there will be a $5.00 per day storage
fee and a late charge fee added to the invoice.
- After 90-days unit will be disposed of.
- If a check is dishonored
for any reason by the bank on which it is drawn, the customer agrees to
pay Auburn Metrology Lab Inc. current bank fee for dishonored
checks. In addition customer agrees to pay any other reasonable
charges imposed by any check verification company or collection agency
that we may use to collect funds due to us.
- If a term invoice is not
paid per Terms Agreement between Auburn Metrology Lab Inc. and a
customer who requested the service, Auburn Metrology Lab Inc. reserves
the right to change Payment Terms with that customer or terminate
existing Credit Terms for this customer.
- We accept
VISA, MASTERCARD, AMERICAN EXPRESS AND DISCOVER CARD, PREPAID BY WIRE
TRANSFER (FEE APPLIES), CASHIER’S CHECK IN U.S. FUNDS.
- We cannot accept
personal checks or certified personal checks. Money orders may
result in significant delays.
- We do not accept COD orders.
- SHIPPING AND FREIGHT
CHARGES
- All shipping, freight
charges and insurance will be paid by the customer.
- All sales are made FOB
point in Bowling Green, Kentucky and are prepaid and added to the
invoice, billed collect or billed to a 3rd party.
- Sales tax is charged on
shipment in the state of Kentucky, unless a customer has tax-exempt
status or Auburn Metrology Lab Inc. has customer’s resale
certificate. If you have tax-exempt status, you must provide a
valid tax exemption number evidencing your status at the time of
purchase. Auburn Metrology Lab Inc. will not refund tax amounts
collected in the event a valid number is not provided. If you
provide a number that is not accepted for any reason by any
governmental or regulatory authority, and Auburn Metrology Lab Inc. is
required to pay tax on your purchase, you will reimburse Auburn
Metrology lab Inc. for the amount of such tax, and Auburn Metrology Lab
Inc. reasonable expenses incurred in connection with the payment and
collection of such tax. You can fax your resale sales tax
certificate to: 270-393-9715, Attention: Sales Tax.
- In addition to the United
States and its territories, Auburn Metrology Lab, Inc. accepts
international orders. All orders of international origin are
exported from the U.S. in accordance with the Export Administration
Regulations. Diversion contrary to U.S. Law is prohibited.
An additional handling charge may apply for processing and
invoicing. All duties, taxes and fees will be the responsibility
of the customer.
- If you receive
merchandise that has been damaged in transit, it is important to keep
the shipping carton, packing material and parts intact.
- Please contact Auburn
Metrology Lab, Inc.- Customer Service representative immediately to
initiate a claim.
- Auburn Metrology Lab Inc.
accepts merchandise return subject to the terms outlined below.
Auburn Metrology Lab Inc. will repair or replace the product at out
option. To facilitate processing of returned merchandise:
- Return freight charge
must be prepaid. No COD-s or CALL TAGS!
- Auburn Metrology Lab Inc.
hourly rate is US $55 per hour and subject to the terms outlined
below. Standard calibration for all instruments is US $375.
Estimates
will be given prior to repair if requested.
If an estimate is not approved there will be a basic charge of
two hours
labor.
- Return freight charge must be
prepaid.
- C.O.D. returns are not accepted.
- Any instrument left over 90-days at
our facility and not claimed by the owner will be disposed of
(exception: instruments waiting for parts).
- Auburn Metrology Lab Inc.
warranty period is 30 days on repairs and 90-days on sale units,
subject to the terms outlined below:
- All warranty seals must
be intact. If the warranty seal is broken, warranty will be void.
- Warranty does not apply
to units that have been subject to misuse (including without limitation
static discharge), abuse, neglect, accident or modification.
- Return freight charge to
our repair facility must be prepaid.
- C.O.D. returns and CALL
TAGS are not accepted.
- Defective merchandise
must be in the original packaging.
